DEATH ON OR AFTER 1ST JANUARY 1898

WILL

BE IT KNOWN that Henry Mossop of 11 Lincolns Inn Fields in the County of Middlesex and of the Grange, Ashford in the said County formerly of Caversham House Oakhill Road Putney in the County of Surrey died on 31st day of December 1918 at the Grange aforesaid.

AND BE IN FURTHER KNOWN that at the date hereunder written the last will and testament with two codicils thereto of the said deceased was proved and registered in the Principal Probate Registry of His Majesty’s High Court of Justice, and that administration of all the estate which by law devolves to and vests in the personal representative of the said deceased was granted by the aforesaid Court to Madeleine Mary Mossop of the Grange aforesaid, Widow the Relict of deceased the Executrix named in the said Will, Leonard Mossop of 2, New Square Lincolns Inn in the County of Middlesex, Barrister, the Executor named in the first Codicil to the said Will and Sir Hedley Francis Le Bas of Clun House Surrey Street Strand in the County of Middlesex Knight , the Executor Named in the second Codicil of the said Will.

I HENRY MOSSOP of Caversham House Oakhill Road-Putney in the County of London, Solicitor revoke all testamentary dispositions by me heretofore made and declare this be my last will I appoint my wife Madeleine Mary Mossop my partner George Francis Berney and my friend John Cunninghame of Earlsfield Road Wandsworth to be the EXECUTORS and Trustees of this my will And I give to each of them the said George Francis Berney and John Cunninghame provided he shall prove and accept the trusts of this my will a legacy of fifty guineas free of duty I give the following legacies namely To my said wife two hundred pounds ( to be paid to her as soon as conveniently may be after my decease) and all my furniture plate plated articles wearing apparel Billiard table and articles used in connection therewith watches, trinkets books prints pictures wines and consumable stores glass linen china and other articles of household or domestic use or ornament including my pictures at my London office To each of my clerks Ralph Dixon Pond and William Henry Mayne if he shall be in my or my firms employ at the time of my death the sum of fifty pounds To every other clerk in my firms employ at the time of my death who should have been so employed for the twelve months preceding my death the sum of five pounds All the legacies hereinbefore mentioned to be free of duty I devise and bequeath Page 2 all my real estate and my personal estate whatsoever and whatsoever not otherwise disposed of my this will or any codicil hereto unto and to the use of my trustees their heirs executors administrators and assigns according to the nature and tenure of the same estate respectively Upon trust to sell call in collect or otherwise convert into money such part of the said trust premises as shall not consist of ready money and out of the moneys to arise from such sale calling in collection or conversion and the ready money of which I shall be possessed at my death to pay my funeral and testamentary expenses and debts and the pecuniary legacies bequeathed by this my will or any codicil hereto and the duties in respect of the said legacies as are given free of duty and to invest the residue of the same in manner herein after authorised with power from time to time to vary such investments and to stand possessed of the said residuary money and the investments from time to time representing the same ( herein after called the said trust fund) Upon trust to pay the income thereof to my said wife during her life and subject thereto In trust for my child or children who shall be living at the date of my death and shall attain or have attained the age of twenty one years and if there shall be more than one child then equally between them Provided always that if any child of mine shall die in my lifetime or under the age of twenty one years after my death leaving a child or children who shall attain the age of twenty one years then and in every such case such last mentioned child or children shall take and if more than one equally between them the share which his her or their parent would have taken of and in the said trust funds if such parent had survived me and attained the age of twenty one years And I declare that all moneys subject to the trusts hereof and requiring investment may be invested in any manner authorised by law for the investment of trust funds Or upon mortgage of hereditaments held by lease or under lease at ground rent for a term of not less than sixty years to run at the time of investment to the extend of two thirds of the fair estimated value of the said leasehold heriditaments Or in the purchase of freehold or leasehold heriditaments held subject to a ground lease or ground leases any leasehold hereditaments desired to be purchased to be held by lease or under lease for a term of not less than eighty years from the time of purchase and at a ground rent not exceeding one fifth of the fair estimated rack rental of the property at the time of its purchase but no purchase or mortgage of freehold or leasehold heriditatments to be made except upon the advice and report of an independent and qualified surveyor or valuer previously instructed by my trustees Or in the purchase of the preference shares or stock or the debenture or debentures stock of any railway gas or water company in England or any debentures or debenture stock of any brewery in England which shall for the three years preceding such investment have paid a dividend of not less than two per cent upon its ordinary shares or stock Or in the purchase of any inscribed stock of any British Colony or Dependency And I also declare that the whole of the income and annual produce arising from every or any part of my estate ( real or personal) of whatsoever description and whether property of a wasting character

or not shall as well during the first year from my death as at all times afterwards be applicable as income under the trusts of this my will no part thereof being in any event liable to be retained as corpus or capital but no part thereof not actually producing income shall be deemed to entitle any party to the receipt of income Provided always and I declare that my trustees may retain so long as they think proper any investments held by me at the time of my death whether such investments be of a character authorised by this my will or not and whether of a wasting character or not and my trustees shall not be answerable for any loss occasioned thereby And I declare that during the minority of any person presumptively or contingently or otherwise entitled to any interest in the said trust fund my trustees may at their discretion exercise or concur in exercising in respect of or over any of the Settled property any of the powers by law conferred upon tenants for life of Settled Lands And I declare that my trustees shall have the fullest powers of determining whether any moneys forming part of my estate shall for the purposes of this my will be treated as capital or as income and whether any expenses costs or other payments or liabilities whether in regard to repairs insurance or otherwise in respect of my estate shall be paid out of capital or income respectively And I also declare that my trustees may demise any house property for the time being forming part of my estate for such term or terms and generally upon such conditions as they may think fit And I declare that my trustees may postpone the sale calling in collection and conversion of all or any part or parts of my estate for so long as they think proper but my real estate shall be considered as personalty from the time of my death and be transmissible accordingly And I declare that my trustees shall have full power to determine all questions and matters of doubt and difficulty arising from the execution of the trusts of this my will or any codicil hereto and every such determination whether made upon a question actually or formally raised or implied in the acts or proceedings of my trustees shall be conclusive and binding on all persons interested under the trusts of this my will or any codicil thereto And I declare that my trustees may in the conduct of the trust business instead of acting personally employ or pay an Agent or Agents whether being Solicitor or any other person or persons to transact any business and do any acts required to be done in the trusts hereof And I declare that it shall be lawful for any of my trustees and executors who may be a Solicitor or engaged in any other profession or occupation to transact any business occasioned by the trusts powers or provisions of this my will or otherwise connected with the getting in or management of my estate or effects whether such business be or be not of the character usually transacted in the course of such profession or occupation and that he shall be allowed to make the usual professional or any other reasonable charges for all business done and time expended in relation thereto in spite of his being a trustee or executor or of any theory practice or thing to the contrary And I direct that it is my desire that every vacancy occurring in the trusteeship of this my will shall be filled with all convenient speed so

that there may if practicable always be at least three trustees of this my will but nothing herein contained shall render my trustees or trustee for the time being liable in the event of any vacancy not having been filled on the ground that in the opinion of other trustees they she or he are or is reasonably unable to procure as an additional trustee any suitable person or persons to act in such capacity or shall as against any person dealing with my trustees in any way invalidate the transaction or affect such person and no purchaser lessee or other persons dealing with my trustees shall be concerned or entitled to see or enquire whether such my desire has been fulfilled or to raise any objection on the ground of its non fulfilment Provided nevertheless and I hereby declare that no trustee of this my will shall be entitled to officiate so long as she or he is a sole or surviving trustee thereof except as far as it may be necessary so to do in connection with the appointment of another trustee or trustees or for the purposes of resigning his trust upon the occasion of the appointment of two or more trustees of this my will And I declare that the expression “ my trustees” herein occurring shall include and all powers ad discretion hereby or by any codicil hereto or by law vested in my trustees shall be exercised by my said wife and the said George Francis Berney and the said John Cunninghame and the survivors and survivor of them and the executors or executors of such survivor or other the trustees or trustee for the time being of his my will IN WITNESS thereof I have hereunto set my hand this fourth day of April one thousand nine hundred and one HENRY MOSSOP signed by the testator as and for his last will in our joint presence and attested by us jointly in his presence Hy COLLEY – R W Fairfax Clerks to Messrs Pollock and Co Solrs 6 Lincolns Inn Fields WC THIS IS A CODICIL to the last will and testament dated the fourth day of April one thousand nine hundred and one of me HENRY Mossop of Caversham House Oakhill Road Putney in the County of London Solicitor I revoke the appointment of George Francis Berney as one of the Executors and Trustees of my said will and the legacy or other benefit given to him hereby and I appoint my cousin Leonard Mossop of Lincolns Inn in the City of London Barrister at Law to be one of the EXECUTORS and Trustees of my said will in the place of the said George Francis Berney and jointly with my wife and friend John Cunninghame and I give to the said Leonard Mossop provided he shall prove and accept the trusts of this my will one debenture of one hundred pounds and ten shares of one shilling each in the New Manor Golf Club Ashford Limited such legacy to be free of legacy duty IN WITNESS thereof I have hereunto set my hand this third day of November one thousand nine hundred and five HENRY MOSSOP Signed by the above named testator as and for a Codicil to his last will in our joint presence and attested by us jointly in his presence WILLIAM H MAYNE – ERNEST B DURBAN Clerks to Henry Mossop Solicitor 11 Lincolns Inn Fields WC THIS IS A SECOND CODICIL to the will of me HENRY
