Salem's Will

BE IT KNOWN that at the date hereunder written, the last Will and Testament with a codicil thereto, of Salem Cross late of Brentford in the County of Middlesex Gentleman deceased who died on the 21st day of May 1884 at Brentford aforesaid was proved and registered in the Principal Registry of the Probate Division of Her Majesty’s High Court of Justice, and that Administration of the personal estate of the said deceased was granted by the aforesaid Court to John Mossop of Caversham House Putney Bank Manager the surviving Executor named in the said Will he having been first sworn well and faithfully to administer the same. Dated the 4th day of July 1884 Gross Value of Personal Estate … £10527. 7. 11.

This is the Last Will and Testament of me Salem Cross of Brentford in the county of Middlesex Gentleman I devise any real estate of which I may die possessed unto my son Charles James Cross his heirs and assigns absolutely and for ever but I declare that if at the time of my decease there shall be any legal Mortgage or equitable charge on such real estate or if any sum shall be due to my bankers on a deposit of the deeds thereof such legal Mortgage equitable charge or sum as the case may be shall be charged upon and payable out of my said real estate and my said son Charles James Cross shall take such real estate subject thereto I direct the payment of all other my just debts funeral and testamentary expenses as soon as convenience may be after my decease I give and bequeath to the said Charles James Cross my silver gilt rosewater dish to my son John Cross my silver claret jug to my son Thomas Coxhead Cross my silver tea pot the said articles to be to and for the respective absolute use and benefit of them my said sons respectively I give and bequeath to my sons in law Alexander Thomas and John Mossop as joint tenants the sum of five hundred pounds and I give and bequeath all other my personal estate and effects whatsoever and wheresoever and of what nature or kind soever and all my estates and effects over which I may have any power of appointment unto the said Alexander Thomas of High Street Homerton in the County of Middlesex Commission Agent and the said John Mossop of the branch of the South Western Bank at Wandsworth in the County of Surrey Gentleman upon trust to collect get in and convert the same into money and thereout to pay the legacies which I bequeath by this my Will or which I may bequeath by any Codicil hereto I give unto each of them the said Alexander Thomas and John Mossop the sum of twenty five pounds free of legacy duty in acknowledgement of the trouble that they will have in the execution of the trusts of this my Will and I give unto each of my dear children Mary Anne Macintyre, Fanny Thomas, Elizabeth Mossop, Maria Thomas, John Cross and Thomas Coxhead Cross the sum of one thousand pounds absolutely And whereas my son John Cross is indebted to me in an amount somewhat exceeding the said legacy of one thousand pound Now in case he shall be indebted to me at the time of my death in an amount exceeding his said legacy I hereby release and forgive him from the excess I give and bequeath to my daughter in law Emma Charlson the sum of Two hundred and fifty pounds and to her son my grand son Salem Cross the sum of One thousand pounds to and for their respective absolute use and benefit I give to Mrs Susanna Cross the widow of my late brother James Usher Cross the sum of Two hundred and fifty pounds absolutely I give to Herbert son of my late sister Myra Blake the sum of Two hundred and fifty pounds absolutely I give to Mrs Elizabeth Stroud daughter of my late sister Elizabeth Westley Two hundred and fifty pounds and to Mr George Westley son of my said sister Elizabeth Westley Two hundred and fifty pounds absolutely I give to Miss Eliza Harford and Miss Louisa Harford the sum of One hundred pounds each free of legacy duty absolutely to Mrs Eliza Cross wife of the said Charles James Cross-Mrs Ellen Cross wife of the said John Cross and Mrs Bessie Cross wife of the said Thomas Coxhead Cross the sum of One hundred pounds each absolutely And I give the ultimate residue of my Estate to the said Charles James Cross John Cross and Thomas Coxhead Cross absolutely and to be equally divided between them I give devise and bequeath all Estates and effects vested in me by way of any trust or upon mortgage unto the said Alexander Thomas and John Mossop their heirs executors administrators and assigns upon and subject to the trusts upon which I may hold the same I expressly authorise and empower the said Alexander Thomas and John Mossop to use their own discretion whether to call in or continue the loans which I have made to the said Charles James Cross for the purposes of his business for such time (not exceeding five years from my decease) and upon such terms in all respects as they may deem advisable without being in any way responsible for the same it being my wish that they should consult the convenience of the said Charles James Cross in reference to the time and mode of repayment of the said loans and I declare that the legatees under this my Will shall in all respects be bound by the acts of the said Alexander Thomas and John Mossop with reference to the said loans but if the said loans are not paid within one year of my decease the legacies the payment of which may be thereby postponed shall carry interest at five pounds per centum per annum from my decease And as to all the legacies payable under this my Will to any persons who may be married women either at the time of my decease or at the time of the payment of the said legacies I devise that the same shall be for their own sole and separate use free from the debts control and engagements of their husbands and payable to them on their own sole and separate receipts alone I appoint the said Alexander Thomas and John Mossop Executors and Trustees of this my Will and declare that they and any new trustees of this my Will shall have a general power of Sale over all my estate and I direct that this my Will shall be read and construed as if I had embodied in it the general powers and provisions contained in the Thirty first section of the Act of Parliament made and passed in the session of the twenty second and twenty third years of the Reign of Her present majesty Chapter 35 and of the Act of Parliament made and passed in the session of the twenty third and twenty fourth years of the same reign Chapter This is a Codicil to the last Will and Testament of the within named Salem Cross I absolutely revoke and make void the legacy of five hundred pounds given by my said Will to my sons in law Alexander Thomas and John Mossop and I dispose of the said sum of Five hundred pounds as follows I give and bequeath to them my said sons in law the sum of one hundred and fifty pounds upon trust for the three children of my late nephew James Blake to be equally divided between them with all accumulations thereof share and share alike as and when they respectively shall attain the age of twenty one years with benefit of survivorship between them the said children if any or either of them shall die under that age And I expressly authorise and direct my said sons in law to expend the whole or any part of the respective presumptive shares of the said Children in the said trust legacy for the benefit of such children respectively during their respective minorities and I declare that my said sons in law shall be at liberty to pay the amount of the said legacy or any part of it to Mr Wheeler the Uncle of the said children on the account of the said children on his receipt and that the said Mr Wheeler shall be at liberty to expend and disburse the same during the minorities of the said children in such way as he may deem most for the benefit of the said children respectively I give to each of them my seven surviving children the sum of fifty pounds in addition to all other benefits which they may take under this my Will and I direct that the clause in my said Will with reference to married women shall apply to the legacies given by this Codicil In all other respects I confirm my said Will In witness whereof I the said Salem Cross have to this which I declare to be a Codicil to and to be taken as part of my said Will set my hand this eighth day of November One thousand eight hundred and eighty – Salem Cross-Signed by the said Salem Cross the testator as and for a Codicil to his last Will and testament in the presence of us present at the same time who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses – Henry Sandford Sol (icitor) 36 King Street Cheapside - Ebenr Josh Edmonds – Clerk to Messrs Potter and Sandford Solicitors 36, King Street Cheapside

On the 14th day of May 1884 Probate of this Will with a Codicil was granted to John Mossop the surviving Executor.

Salem Cross was born in 1799 in Cheapside and died on 21 May 1884 at Brentford. His daughter Elizabeth Cross married John Mossop. He was a soap manufacturer.

It it is not yet clear how Charles Frederick Cross (1855-1935), pictured above, the inventor of artificial silk was connected to this family. He was remembered by Robert Russell as good at chemistry and going to Zurich. Robert met him when Cross was very old and living in Seaford. Robert thought he was probably a great great uncle.
